Residency
All incoming students are classified as residents or nonresidents of
California for tuition purposes. Students seeking classification as
residents must submit a Statement of Legal
Residence, signed under oath.
Detailed information about residency will be sent to admitted students.
To be classified as a resident for tuition purposes, you must
demonstrate: 1) a one-year continuous, physical presence in California
for one year prior to the residency determination date; 2) intent to
remain a permanent California resident; and, 3) financial independence
from your parents for one year if they reside outside of California. A
student shall be considered financially independent if he/she has not
and will not be claimed as a tax dependent for state and federal tax
purposes by out-of-state nonresident parent(s) in the calendar year
prior to the reclassification application. Classification as a resident
at another University of California campus does not automatically render
one a resident at Hastings College of the Law, as the qualifications of
residency differ. If a student is incorrectly classified because of any
concealment of facts or untruthful statements, the student will be
required to pay all tuition fees that would have been charged but for
the erroneous classification and will be subject also to College
discipline. Special
rules
If you fall under any of the following categories, special rules may
apply to you: (1) member of the military; (2) dependent of military
personnel; (3) dependent of a veteran disabled or killed in duty; (4)
child of a deceased public law enforcement or fire suppression
employee.
Reclassification of tuition status
A student classified as a nonresident will retain that status until that
student submits, and the College approves, a Petition for
Reclassification. A Petition for Reclassification may be submitted
before the start of any semester after all residency requirements have
been met. Inquiries
All inquiries regarding residence requirements, determinations, and
special rules should be directed to the Residency Officer, Office of the
General Counsel, Hastings College of the Law, 200 McAllister St., San
Francisco, CA 94102; telephone (415) 565-4715.
